WILLS AND TRUST

Q:  I have no to very little assets, do I really need a will?

A.  Yes, a will helps not only to disburse your current assets, but will help to disburse any assets you may have in the future, who will be the guardian of your children, and other important aspects in your life. 

Q.  I have heard that I should have a trust to avoid my family from pay taxes?

A.  A trust is a very difficult and fact sensitive instrument that a qualified attorney must answer, knowing your complete list if assets.  The majority of people do not need a trust. 

BANKRUPTCY

Q.  Will bankruptcy hurt my credit rating?

A.  Yes.  However, the person who normally is contemplating bankruptcy already has a poor credit rating and the bankruptcy already has a poor credit rating and the bankruptcy will not hurt it any more that it already is damaged. 

Q.  I hear that if I file bankruptcy that I will lose everything and a person will come in my house and take everything I own, is that true?

A.  No. Under Ohio law a person has certain exemptions that allow them to keep most of the personal affects they own.  However, you must see an attorney to determine what those exemptions are and if your entitled to them. 

DIVORCE

Q.  I am not happy with my marriage.  Will the court give everything I own to my spouse?

A.  No.  In the state of Ohio all assets that are acquired in a marriage are to split equally among the parties.  Any assets that a person had prior to the marriage are theirs solely.  However, this is a very fact sensitive matter that must be reviewed with an attorney before making such an important decision.

Q.  Does a mother always have the upper hand in a custody battle?

A.  No.  The court looks at many different aspects of the family life of the children and tries to make its decision in the best interest of the child or children and not the sex of the parent.
